Cyan Terms of Service

These Terms of Service govern purchases of Cyan products and use of the Cyan website and related services operated by Nexus Dynamics LLC.

By using the website or purchasing a Cyan product, you agree to these Terms.

Products and Orders

We attempt to describe our products, features, pricing, and availability accurately. Product appearance may vary slightly because of displays, manufacturing variations, photography, or product updates.

Submitting an order does not require us to accept or fulfill an order that involves suspected fraud, an obvious pricing or technical error, unavailable inventory, invalid shipping information, legal restrictions, or circumstances that make fulfillment impracticable.

If we cancel an order after payment has been collected and the order will not be fulfilled, we will issue an appropriate refund.

Pricing and Payment

Prices are displayed before purchase and may change for future orders.

Applicable taxes and other charges, when required, are calculated or displayed during checkout.

Payments are processed through third-party payment providers such as Stripe. Your use of their payment services may also be subject to their terms and policies.

Shipping, Returns, and Warranty

Shipping and returns are governed by our Shipping & Returns Policy.

Eligible product defects are governed by our One-Year Limited Warranty.

Those policies form part of the terms applicable to your Cyan purchase.

Smart-Glasses Features and Responsible Use

Cyan smart glasses may include cameras, microphones, recording capabilities, wireless features, or other technology that can be subject to privacy, recording, safety, or other laws.

You are responsible for using Cyan products lawfully and responsibly.

Laws concerning photography, audio recording, video recording, surveillance, consent, privacy, and use of electronic devices vary by location and circumstance.

You are responsible for obtaining any consent required by applicable law and for respecting the privacy and rights of others.

Do not use Cyan products in a way that is unlawful, deceptive, harassing, dangerous, or invasive of another person’s legally protected privacy.

Driving and Safety

Do not operate or interact with Cyan products in a manner that distracts you while driving, operating machinery, or performing another activity requiring your full attention.

You are responsible for complying with applicable traffic, workplace, safety, and device-use laws.

Website Use

You may not use our website or services to:

• Violate applicable law;
• Attempt unauthorized access to systems or accounts;
• Interfere with website operation or security;
• Introduce malicious code;
• Commit fraud or impersonate another person;
• Abuse purchasing, refund, warranty, or support processes; or
• Infringe the rights of Nexus Dynamics LLC or others.

Intellectual Property

The Cyan name, branding, website content, graphics, product presentation, software, and other materials made available by Nexus Dynamics LLC may be protected by intellectual-property laws.

Except as permitted by law or expressly authorized by us, you may not copy, reproduce, distribute, modify, or commercially exploit protected Cyan or Nexus Dynamics materials.

Third-party trademarks and technology remain the property of their respective owners.

Third-Party Services

Cyan may rely on third-party services for payments, hosting, communications, shipping, fulfillment, or other functions.

We are not responsible for every interruption, delay, or failure caused solely by a third-party service or circumstances outside our reasonable control, subject to rights you may have under applicable law.

Disclaimer and Limitation of Liability

To the extent permitted by applicable law, Cyan products and services are provided subject to the warranties and protections expressly stated in our policies and any non-waivable rights provided by law.

To the extent permitted by law, Nexus Dynamics LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from use or inability to use a Cyan product or service.

To the extent permitted by law, our aggregate liability arising from a particular product purchase will not exceed the amount paid for that product.

These limitations do not apply where applicable law prohibits their exclusion or limitation.

Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, or expenses resulting from your unlawful misuse of Cyan products or services or your material violation of these Terms.

Changes to These Terms

We may update these Terms from time to time.

Changes apply prospectively unless applicable law requires otherwise. The current version will display its effective or “Last Updated” date.

Governing Law

These Terms are governed by applicable law, including the laws of the State of Missouri, without limiting consumer protections or other rights that may apply based on a customer’s location and that cannot legally be waived.

Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
